Labor laws are based on a combination of federal and state constitutions, legislation, administrative rules, and court opinions designed to protect the interests of both workers and employers. Due to changing global economic realities, amendments to the long-standing 1964 Kuwait Labor Law issued by Shiek Jaber Al-Ahmed Al-Jaber became necessary.

The amendments to the labor law were drafted by the Ministry of Social Affairs and Labour. Employers were represented by the Kuwait Chamber of Commerce and Industry, and workers by the Confederation of Kuwait Workers. Opinions by various government agencies, as well as the obligations of International Labour Conventions were also considered before the draft was ratified and became law.

Another function of Labor Law is the legal expression of the religious beliefs and social customs of a society through the appointment of official holidays. According to Article 68 of the Kuwaiti State New Private Sector Labor Law No. 6 of 2010, the law declares thirteen days a year as official holidays. Workers are eligible for double the rate of remuneration for working on those days as well as an alternative compensation day.
